A 26 yr old Evansville man pleaded guilty to a charge each of neglect of a dependent and battery resulting in serious bodily injury to a person less than 14 years of age, both class B felonies. The sentencing range for a class B felony is six to 20 years and a fine of up to $10,000.

According to a police probable cause affidavit, he said he repeatedly shook and spanked the child because she would not stop crying. The child’s mother “adamantly denied that she inflicted any injuries to the child, but that her husband was responsible for them,” according to the affidavit.
He pleaded without a plea agreement, so when he is sentenced by Superior Court Judge Wayne Trockman on June 8, it will be up to the court’s discretion how much time he serves.

Felony charges should have been filed against all four former Carmel High School basketball players in alleged assaults on a team bus and in the locker room, an attorney for one student allegedly assaulted in both situations said Tuesday.

The charges stem from the Jan. 22 bus incident, plus earlier incidents in the high school locker room from Nov. 1 to Jan. 21.

“I’m not surprised by the charges,” said attorney Robert Turner, who is representing a 15-year-old freshman allegedly assaulted both in the locker room and on the bus as it returned from a game in Terre Haute. “But based on what my client told me, there was criminal conduct that took place that would support felony charges.”
