DOTHAN, Ala. – A Houston County judge removed the City of Dothan from a lawsuit recently after determining the city is immune from liability.  Circuit Judge Larry Anderson granted summary judgment to the City of Dothan in a wrongful death suit brought by Mary Downing, whose husband was killed by an intoxicated driver in January 2007, just minutes after the driver had been stopped and released by police officers.

The lawsuit claims that if police officers arrested Tabitha Farmer on the evening of Jan. 13, 2007, for driving under the influence she would not have gone on to kill the 60-year-old Downing, crushing him against the wall of the outside of the building at Southern Family Market, now Bruno’s.

Attorneys for the City of Dothan filed a motion for summary judgment, claiming Alabama law protects the discretionary decisions of officers, so long as those decisions are not made maliciously, fraudulently, or in bad faith.
“The plaintiff has not put forth any evidence that the officer acted willfully, maliciously, fraudulently, or in bad faith, or beyond his or her authority, or under mistaken interpretation of the law,” Anderson wrote in his ruling, dated March 5.

Tabitha Farmer, 27, pleaded guilty to murder and was sentenced to serve 25 years in prison. Farmer and Southern Family Markets remain defendants in the wrongful death suit.

“The court’s ruling points to the Alabama Legislature’s answer to the problems caused when law enforcement is not allowed to make their own decisions,” Dothan City Attorney Len White said in a written statement.

 

SULLIVAN, Ind. (AP) — The criminal trials of a former Indiana pastor and his sons charged with bilking church members nationwide out of millions of dollars could be delayed for months.  Sixty-five-year-old Vaughn Reeves was set to go to trial June 6 in Sullivan County, but a special judge granted a defense motion for a continuance. No new date has been set.

A judge in Gibson County also postponed the Aug. 17 trial of Reeves’ son Chip. That trial is now expected to start in January. A Daviess County judge has said she also delay the July 27 trial date for Joshua Reeves. Chris Reeves’ Martin County jury trial is still set for Aug. 17.
All four have pleaded not guilty to charges that they pocketed about $6 million from investments in church construction projects.

The Tribune-Star Reported That A West Terre Haute man faces criminal charges after kicking out a window of a police car. He was arrested on preliminary charges of intimidation, criminal mischief and public intoxication. He appeared Thursday in Vigo Superior Court 1 where Officer Teddy York of the West Terre Haute Police Department reported that police were called to a home on South Eighth Street at about 6:15 p.m. Tuesday.

York said a woman called police to report that the man was an unwanted guest at the home. At one point, the man allegedly had a knife and threatened to harm people. He had a .28 percent blood-alcohol content when arrested. In Indiana, .08 percent BAC is considered legally intoxicated. Judge Michael Eldred heard that Wallace has prior arrests for assault, disorderly conduct, probation violation and evading police.

“This is good,” Tholen, who works for the Department of Natural Resources, said Sunday as he drove around Lake Shafer. “I like seeing a boating season start off this way.” The lake seemed to be busy with tubers, skiers, speedboats and jet skis as residents and visitors alike marked the traditional opening of lake season with a splash.

Great vacation weather usually means a lot of lake traffic, Tholen said. That makes water safety especially important to keep in mind, he said, as boaters head out for fun. Indiana Conservation officers typically are out in full force on weekends. This weekend, they’ve mostly given warnings to remind boaters of the rules, Tholen said.

However, one particular infraction is sure to net a ticket. “The life jacket requirement is my biggest thing,” Tholen said. “If you don’t have a life jacket, you’re getting a ticket.” Indiana State law requires that boaters carry with them enough accessible, appropriately sized life jackets for everyone on board, Tholen said. Boats longer than 16 feet also must carry a throwable flotation device. Boat and jet ski drivers must be at least 16 years old and hold a valid driver’s license, Tholen said.

Conservation officers’ main concerns as boating season ramps up is to make sure boaters are safe while they have fun, he said.

 

The Associated Press reported that a leading red-light camera enforcement company has given up its efforts to get the General Assembly to pass an Indiana law that would authorize its services.

An Arizona-based corporation that operates in 21 states has canceled its registration to lobby the General Assembly after spending $54,241 between February 2009 and April 2010.

The company worked to pass a state law after former Attorney General Steve Carter issued an August 2008 opinion saying red-light violations broke Indiana state law, not local ordinances, so the General Assembly would need to explicitly grant local governments the authorization to regulate those violations. That hasn’t happened.

 

The Indiana State Police recently conducted a sobriety checkpoint in Wayne County in conjunction with “Operation Click It or Ticket” for the Memorial Day holiday weekend.Motorists were asked to have their driver’s license and vehicle registration readily available when entering the checkpoint.  Motorists can expect short delays of only two to three minutes during the checkpoint.
