I.C. 35-49-2-1 attempts to define an "obscene performance," but that definition is hopelessly vague and almost 100% subjective. Does that mean that I can't have sex with my wife? She's a little tiger sometimes and we can get pretty uhhhmm . . . obscene . . . if you know what I mean. Surely that's not illegal? What if the wifey and I want to . . . uh . . . you know, videotape our activities? Is that illegal in Indiana? Have we engaged in an obscene performance? Can we go to jail or pay a fine for it? I am asking these questions in good faith--not facetiously at all. I am really curious as to how our lawmakers stand on this kind of stuff. I want my elected leaders to stay out of my bedroom.
